By creating an account, accessing, or using MuzikiAfrika (the “Platform”), you agree to these Terms & Conditions (“Terms”). If you do not agree, do not use the Platform.

• You must be 18 years or older to register as an Artist.
• Listeners must meet the minimum age required by Kenyan law to use digital services. If you are under 18, you must have a parent/guardian’s permission.

• You are responsible for keeping your login credentials secure and for all activity under your account.
• You must provide accurate information and keep it updated.

By registering as an Artist, you confirm that:

• You are 18 years of age or older.
• You have provided a valid, government-issued ID (National ID, Passport, or equivalent).
• All identity information submitted is accurate and belongs to you.

You understand that providing false identity information may lead to:

• Account suspension or deletion
• Permanent ban from the Platform
• Potential legal action under Kenyan law

As an Artist, you are solely responsible for all content you upload, including:

• Audio files
• Cover art
• Copyright and ownership documents
• Song metadata
• Any other supporting documents

You confirm that:

• You own the rights to your music or have full permission from the rightful owners.
• Your uploads do not violate any copyright, trademark, or intellectual property laws.
• Your content does not contain illegal, hateful, harmful, or defamatory material.

The Platform does not take responsibility for verifying the legitimacy of your ownership until an internal review is done.

You are strictly prohibited from using the Platform to:

• Upload copyrighted music you do not own
• Upload stolen, pirated, or AI-generated content without rights
• Impersonate another artist or public figure
• Commit fraud or misrepresentation
• Harass, threaten, or harm any user
• Engage in any activity prohibited by Kenyan law, including the Computer Misuse and Cybercrimes Act, 2018

Any illegal activity performed by an Artist is entirely their own responsibility.

To the fullest extent permitted by Kenyan law:

• The Platform is not liable for any illegal, fraudulent, or infringing content uploaded by Artists.
• The Artist accepts full legal responsibility for their actions and uploads.
• The Platform is not responsible for any disputes between:
  • Artists and producers
  • Artists and labels
  • Artists and third-party copyright owners
• The Platform does not guarantee any earnings, promotions, or exposure.

An Artist agrees to indemnify and protect the Platform from claims, damages, or losses arising from:

• Their uploaded content
• Their behavior
• Their breach of these Terms

The Platform reserves the right to:

• Approve or reject any Artist account
• Request additional verification documents
• Remove or hide uploaded content
• Suspend or permanently ban an Artist who violates these Terms or Kenyan law

Actions leading to suspension/termination include:

• Uploading illegal content
• Copyright infringement
• Fraud or misrepresentation
• Abuse of platform systems (in-app purchases, payouts, etc.)

If the Platform processes earnings payouts:

• You must provide an accurate M-Pesa number that belongs to you.
• You are responsible for ensuring your phone line is active and legally registered.

The Platform is not responsible for:

• Incorrect payouts due to inaccurate numbers
• Delays from M-Pesa or Safaricom systems
• Financial disputes outside the platform

By registering as an Artist, you agree to comply with all applicable laws, including:

• Kenya Copyright Act
• Data Protection Act, 2019
• Computer Misuse & Cybercrimes Act, 2018
• Any regional or international copyright laws relevant to your uploaded content

If required by law enforcement, the Platform may cooperate and share account information as legally required.

We may update these Terms from time to time. Continued use after updates means you accept the updated Terms.

These Terms are governed by the laws of Kenya. Any disputes will be handled under Kenyan legal jurisdiction.
